Matt Lindland loudly answered former teammate Dan Henderson’s lawsuit against him over the Team Quest logo and name.

Not only does Lindland now ask the California federal court to dismiss Henderson’s complaint altogether, but in his answer to Henderson’s complaint, he also countersues the Strikeforce light heavyweight champion for claims including trademark and copyright infringement, unfair competition, deceptive advertising, breach of contract, and interference with Lindland’s future business relationships.

Henderson fired the first shot in this legal dispute by filing the lawsuit on Feb. 14, alleging trademark infringement, copyright infringement, and unfair competition against Lindland and his company, Team Quest Fight Club, LLC.

For those interested in intellectual property discussion, this battle between Henderson and Lindland presents a most interesting case study. The 2 sides are suing each other for the rights to use the 'Team Quest' name. Henderson has been using the name and logo before Lindland got involved with the team, but legally, Lindland owns the trademark. But both guys have been using the name without a formal agreement, and are suing to stop the other guy from doing so going forward. This sounds like a common law marriage that's about to end with an ugly divorce settlement. Should be settled with a middleweight match up.

I think its shitty for Dan, because he had been involved with Team Quest well before Linland. But if Linland actually has it trademarked then Dan really has no chance from a legal stand point to make anything happen.

im not a lawyer, but i have taken several business law classes over the years (it was a while back) If Henderson has been has been using the Team Quest Trademark before Linland trademarked it, that might take precedence. Im just speculating because as i said, im no lawyer.

This is exactly the issue I'm looking to discuss. I assume that in the process of trademarking the Team Quest brand, Lindland probably made some claims towards having 'invented' or 'created' the brand . . . unless he had some agreement with Couture/Hendo from back in the day. Lindland's lawsuit makes it sound like this was the case, as he claims that Hendo licensed the Team Quest name to start his gym. I think Hendo's strategy will be to attack the original trademark that Lindland owns, but I'm not sure how difficult this will be to accomplish.

once again, im just speculating... If Linland can prove that he invented/created the brand/logo then i would assume that his case "holds more water". Its kind of a pickle.
