Bingo. The issue is reproduction.

The Hangover lawsuit wasn't about Tyson specifically, it was the fact that the producers of The Hangover reproduced Tyson's tattoo for Ed Helm's character. The movie admits that Tyson's tattoo was the inspiration for reproduction, and hence, they chose to settle because the artist had a case.

This THQ issue may play out the same way. To make their video game facsimile look authentic, they used the original artists work on Condit's body to reproduce a digital facsimile. It would be hard for THQ to argue that their work isn't lifted from the artist's work, since the video game character and the real life fighter have the same name, Carlos Condit.

Interesting to see how this intellectual property case plays out.

well said. its not about the image being see on tv, media or whatever. its about the digital artist copying the tattoo artists original design without permission or compensation. its sounds like a silly case, but usually when you get a tattoo in all the forms you fill out there is a part about the artist work remaining theirs and any use of it without permission is prohibited.

if the artist still has the paperwork he may have a case

I think it's going to resolve to that 20% difference, myself. I've seen other cases that were more solid get tossed in more traditional print-media. If zuffa didn't tweak the work, it serves them right, I guess.

I've designed the bulk of my tats, but I've had a couple one-offs by artists, I've never signed anything to that effect.

I think it's more along the lines of Tyson's artist, where he literally had Tyson sign over reproduction rights to him...if Condit's guy has anything like that, he may have a case...but I don't think boilerplate tat shop don't-sue-me-if-you-get-Hep stuff is going to cut it.

I am quite sure this law was implemented so that people in the relative industry could not copy an artist's work. Not for bastardized use of the law like this.
