We aim to respond to valid DMCA notices within 24-48 hours and will address legitimate copyright concerns promptly and in good faith.

5.5 Counter-Notification

If you believe that material you posted was removed in error or that you have authorization to use the material, you may file a counter-notification containing:

  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification

5.6 Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating accounts of users who are deemed to be repeat infringers. We reserve the right to determine whether conduct violates copyright laws and to take appropriate action.

5.7 Safe Harbor Protection

MMA News operates as an online service provider and qualifies for safe harbor protections under 17 U.S.C. § 512 of the DMCA. We do not have actual knowledge of infringing activity and do not receive financial benefit directly attributable to infringing activity. We reserve the right, but have no obligation, to monitor, review, edit, remove, or disable User Content at any time and for any reason, including if we determine that User Content violates these Terms, is harmful, offensive, or objectionable, or for any other reason in our sole discretion.

We may remove User Content that:

  • Contains hate speech, harassment, threats, or violence
  • Is spam, promotional, or commercial in nature
  • Violates privacy, confidentiality, or publicity rights

12.3 Class Action Waiver

YOU AND MMA NEWS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and MMA News agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class, consolidated, or representative proceeding.

12.4 Exceptions to Arbitration

Either party may seek equitable relief in court for infringement or misappropriation of intellectual property rights without first engaging in arbitration or informal dispute resolution.

12.5 Opt-Out Right

You have the right to opt out of the arbitration provision by sending written notice to legal@mmanews.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision.

13. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Website shall be governed by and construed in accordance with the laws of the United States and the state in which MMA News is located, without regard to conflict of law principles.

To the extent that arbitration does not apply, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in the jurisdiction where MMA News operates. You waive any objection to venue and any defense of inconvenient forum.
